One can love and not forgive or out of love decide not to forgive. Or one can forgive but not love, or choose to forgive but not love the ones forgiven. Love and forgiveness follow parallel and largely independent paths, a truth we fail to acknowledge when we pressure others to both love and forgive. Individuals in conflict, sparring social and ethnic groups, warring religious communities, and insecure nations often do not need to pursue love and forgiveness to achieve peace (...) of mind and heart. They need to remain attentive to the needs of others, an alertness that prompts either love or forgiveness to respond. By reorienting our perception of these enduring phenomena, the contributors to this volume inspire new applications for love and forgiveness in an increasingly globalized and no longer quite secular world. With contributions by the renowned French philosophers Jacques Derrida and Jean-Luc Marion, the poet Haleh Liza Gafori, and scholars of religion, psychoanalysis, Islamic and political philosophy, and the Bible and literature, this anthology reconstructs the historical and conceptual lineage of love and forgiveness and their fraught relationship over time. By examining how we have used--and misused--these concepts, the authors advance a better understanding of their ability to unite different individuals and emerging groups around a shared engagement for freedom and equality, peace and solidarity. News about personal data breaches or data abusive practices, such as Cambridge Analytica, has questioned the trustworthiness of certain actors in the control of personal data. Innovations in the field of personal information management systems to address this issue have regained traction in recent years, also coinciding with the emergence of new decentralized technologies. However, only with ethically and legally responsible developments will the mistakes of the past be avoided. This contribution explores how current data management schemes are insufficient to (...) adequately safeguard data subjects, and in particular, it focuses on making these data flows transparent to provide an adequate level of accountability. To showcase this, and with the goal of enhancing transparency to foster trust, this paper investigates solutions for standardizing machine-readable policies to express personal data processing activities and their application to decentralized personal data stores as an example of ethical, legal, and technical responsible innovation in this field. An issue about the privacy of the clustered groups designed by algorithms arises when attempts are made to access certain pieces of information about those groups that would likely be used to harm them. Therefore, limitations must be imposed regarding accessing such information about clustered groups. In the discourse on group privacy, it is argued that the right to privacy of such groups should be recognised to respect group privacy, protecting clustered groups against discrimination. According to this viewpoint, this right (...) places a duty on others, for example, private companies, institutions, and governments, to refrain from accessing such information. To defend the idea that the right to privacy should be recognised for clustered groups, at least two requirements must be satisfied. First, clustered group privacy must be conceived of as either a collective good or a participatory good. Since these forms of good are of the type from which no member of a group can be excluded from benefiting, the right to them is defined as a group right. Second, there must be group interests on which to base a group right. Group interests can be either the interests of those members that are a result of their being in the group or the interests of the group as a whole that transcend the interests of its members. However, this paper argues that clustered group privacy cannot be conceived of as either a collective or a participatory good because it is possible for some individuals to be excluded from benefiting from it. Furthermore, due to the lack of awareness among individuals that they are members of a clustered group and the nature of a clustered group itself, such groups cannot have the group interests necessary to establish a group right. Hence, the group right to privacy cannot be recognised for these groups, implying that the group right cannot be considered a means to protect clustered groups against discrimination. Instead, this paper suggests that moral principles need to be articulated within an ethics of vulnerability to identify the moral obligations of protecting vulnerable clustered groups. The duty owed to the vulnerable should involve refraining from accessing certain information about clustered groups in specific contexts. This duty is not engendered by the right to privacy of such groups; it is the duty owed to the vulnerable. The findings highlight the need to articulate moral principles regarding privacy and data protection to protect clustered groups in contexts in which accessing information about them could constitute a reason for discriminatory targeting. Professional ethics is one of the important topics, which includes various rights such as respecting the patient’s right to choose, being useful, being harmless, and respecting the justice, integrity, and confidentiality of information. Adherence to these principles can increase the quality of care and patient satisfaction. Since determining the current attitude of students towards ethics plays an important role in educational programs, this study was conducted to evaluate the attitude of nursing and midwifery students of Kermanshah University of Medical Sciences (...) towards six principles of professional ethics. In this cross-sectional study, 76 undergraduate nursing and midwifery students were selected to participate in this study by census method. The data collection tool was a valid and reliable questionnaire on the principles of medical ethics. Data were analyzed using descriptive and inferential statistics. The study sample consisted of 49 nursing and 27 midwifery students with an average age of 23 ± 1.4 years. The mean score of nursing and midwifery students’ attitude towards medical ethics was 95.01 ± 4.8 in basis of 100, and was 94.56 ± 4.9 for nursing students and 96.04 ± 4.7 for midwifery students. Majority of the samples had positive attitude towards medical ethics and 3.73% had a relatively positive attitude. No statistically significant relationship was found between the attitude of students and variables of gender, field of study, marital status, and age. All students in this study had a positive attitude towards the principles of medical ethics, and this is a valuable asset for clinical environments. To increase the generalizability of the study, further studies with bigger sample size on the students of various disciplines of medical sciences is recommended. (shrink)

Personal Information Management Systems (PIMS) aim to facilitate the sharing of personal information and protect privacy. Efforts to enhance privacy management, aligned with established privacy policies, have led to guidelines for integrating transparent notices and meaningful choices within these systems. Although discussions have revolved around the design of privacy-friendly systems that comply with legal requirements, there has been relatively limited philosophical discourse on incorporating the value of privacy into these systems. Exploring the connection between privacy and personal autonomy illuminates the (...) instrumental value of privacy and highlights the importance of intentionally embedding the value of privacy into these systems. To translate the value of privacy into concrete design requirements, this study constructs a values hierarchy consisting of values, norms, and design requirements. After analyzing the relationships between privacy and autonomy and identifying norms, the design requirements translated from the norms associated with the components of personal autonomy are specified at the lowest layer. These requirements include a design to prevent unauthorized access and dark patterns and to provide effective and efficient notices and choices. The findings contribute to expanding the requirements for designing the aspect of privacy as a legal requirement to incorporate the value of privacy into systems. (shrink)

This research explores how a person with whom information has been shared and, importantly, an artificial intelligence (AI) system used to deduce information from the shared data contribute to making the disclosure context private. The study posits that private contexts are constituted by the interactions of individuals in the social context of intersubjectivity based on trust. Hence, to make the context private, the person who is the trustee (i.e., with whom information has been shared) must fulfil trust norms. According to (...) the commitment account of trustworthiness, a person is trustworthy only if they satisfy the norm of competence. It is argued that a person using an AI system to answer a question is competent only if they are ex post justified in believing what has been delivered by the AI system. A person’s belief is justified in the doxastic sense only if the AI system is accurate. This feature of AI’s performance affects a person’s competence and, as a result, trustworthiness. The effect of AI on trust as an essential component of making the context private, and thus on privacy, means an AI system also impacts privacy. Therefore, a private context is constituted when the individual with whom the information is shared fulfils the competence norm and the AI system used for analysing the information is sufficiently accurate to adhere to this norm. The result of this research emphasises the significance of the relationship between individuals involved in information-sharing and how an AI system used for analysing that information impacts the relationship regarding making the context private, as well as how it impacts privacy. The findings of this research have significant implications for improving or ameliorating privacy regulations in light of trust. (shrink)

Mobile phone GPS data, social media data, or other forms of information updates such as the progress of epidemics are used by epidemiologists to recognize disease spread among specific groups of people. Targeting groups as potential carriers of a disease, rather than addressing individuals as patients, risks causing harm to groups. In this paper, it is argued that, when properly revised in the face of counter-examples, the source control and actual access views of privacy are extensionally equivalent but different in their underlying rationales. In this sense, the source control view and the actual access view, when properly modified to meet counter-examples, can be metaphorically compared to ‘climbing the same mountain but from different sides’ (as Parfit [1] has argued about normative theories). This dissertation consists of five chapters, each written as independent research papers that are unified by an overarching concern regarding information privacy and machine learning-based artificial intelligence (AI). This dissertation addresses the issues concerning privacy and AI by responding to the following three main research questions (RQs): RQ1. ‘How does an AI system affect privacy?’; RQ2. ‘How effectively does the General Data Protection Regulation (GDPR) assess and address privacy issues concerning both individuals and groups?’; and RQ3. ‘How can the value (...) of privacy be embedded into systems?’ -/- To respond to the RQs, this dissertation adopts the privacy impact assessment (PIA) as the overall methodology. A PIA encompasses three distinct stages; the first, the analytical stage, concerns the analysis of how AI (particularly focusing on inference as a process that includes inferred information, AI models’ performance, and accessing information uncovered by AI models) impacts privacy. Second, the legal assessment stage concerns whether AI that processes personal information and develops models complies with the GDPR. Finally, the design requirements stage features proposals for design requirements for systems aimed at protecting privacy. Accordingly, this dissertation is structured in three parts, each corresponding to a specific stage of a PIA and responding to one of the RQs. -/- Part I, which addresses the first stage of the PIA, comprises three chapters that altogether respond to RQ1. Chapter 2 analyses how AI impacts the descriptive aspect of privacy; this part argues that AI challenges the current definitions of privacy and that the ‘source control’ and ‘actual access’ definitions of privacy, once revised in the face of counter-examples involving inferred information, converge. Chapter 3, which considers how AI impacts the normative aspect of privacy, particularly the value of privacy, argues that AI affects the social value of privacy, which depends on trust, as this dimension of privacy is constituted when AI models perform accurately. Chapter 4 examines how AI impacts the normative aspect of privacy, particularly the right to privacy, and it argues that, although accessing information uncovered by AI models raises concerns about the privacy of algorithmically designed groups, the right to privacy cannot be recognised for such groups. This is the disruptive feature of AI that has led to consideration of new approaches other than the traditional one, which involves recognising the right to privacy, to protect the privacy of these groups. Instead of recognising the right to privacy for algorithmically designed groups, this chapter suggests taking a moral principle for the moral obligation of protecting vulnerable groups within an ethics of vulnerability. -/- Part II concerns the second stage of the PIA and consists of one chapter that responds to RQ2. Chapter 5, in addition to evaluating whether AI that processes personal information and develops models complies with the GDPR, also assesses whether the GDPR adequately addresses the privacy issues raised by AI. It specifically focuses on group privacy and argues that GDPR has limitations in protecting the privacy of algorithmically designed groups and that the privacy of such vulnerable entities must be considered in the context of privacy and data protection. -/- Part III, which is related to the third stage of the PIA, also consists of one chapter that responds to RQ3. Chapter 6 proposes design requirements to protect privacy by integrating privacy into systems and argues that privacy is instrumentally valuable for the sake of autonomy. Accordingly, to embed the value of privacy into systems, design requirements are articulated through the translation of norms that promote and protect autonomy. (shrink)

There is little information about the content of ethics consultations in pediatrics. We sought to describe the reasons for consultation and ethical principles addressed during EC in pediatrics through retrospective review and directed content analysis of EC records at St. Jude Children's Research Hospital. Patient-based EC were highly complex and often involved evaluation of parental decision making, particularly consideration of the risks and benefits of a proposed medical intervention, and the physician's fiduciary responsibility to the patient. Nonpatient consultations provided guidance (...) in the development of institutional policies that would broadly affect patients and families. This is one of the few existing reviews of the content of pediatric EC and indicates that the distribution of ethical issues and reasons for moral distress are different than with adults. We have conducted (J. L.) and overseen (L. D.) human challenge studies and agree that they can be useful in developing anti-infective agents. We also agree that adults can autonomously choose to undergo risks with no prospect of direct benefit to themselves. However, we disagree that SARS-CoV-2 challenge studies are ethically appropriate at this time, for (...) 3 reasons: (1) current scientific knowledge of SARS-CoV-2 infection is insufficient to manage risks; (2) autonomous decision making, while necessary, does not override concerns about risk; and (3) undertaking challenge studies now would imperil confidence in the research enterprise, potentially undermining the global response to the coronavirus disease 2019 (COVID-19) pandemic. Despite recent advances in HIV prevention and treatment, high HIV incidence persists among people who inject drugs. Difficult legal and political environments and lack of services for PWID likely contribute to high HIV incidence. Some advocates question whether any HIV prevention research is ethically justified in settings where healthcare system fails to provide basic services to PWID and where implementation of research findings is fraught with political barriers. Ethical challenges in research with PWID include concern about whether research evidence will (...) be translated into practice; concerns that research might exacerbate background risks; and ethical challenges regarding the standard of HIV prevention in research. While these questions arise in other research settings, for research with PWID, these questions are especially controversial. This paper analyses four ethical questions in determining whether research could be ethically acceptable: Can researchers ensure that research does not add to the burden of social harms and poor health experienced by PWID? Should research be conducted in settings where it is uncertain whether research findings will be translated into practice? When best practices in prevention and care are not locally available, what standard of care and prevention is ethically appropriate? Does the conduct of research in settings with oppressive policies constitute complicity? We outline specific criteria to address these four ethical challenges. We also urge researchers to join the call to action for policy change to provide proven safe and effective HIV prevention and harm reduction interventions for PWID around the world. (shrink)

We report on the deliberations of an interdisciplinary group of experts in science, law, and philosophy who convened to discuss novel ethical and policy challenges in stem cell research. In this report we discuss the ethical and policy implications of safety concerns in the transition from basic laboratory research to clinical applications of cell-based therapies derived from stem cells. Although many features of this transition from lab to clinic are common to other therapies, three aspects of stem cell biology pose (...) unique challenges. First, tension regarding the use of human embryos may complicate the scientific development of safe and effective cell lines. Second, because human stem cells were not developed in the laboratory until 1998, few safety questions relating to human applications have been addressed in animal research. Third, preclinical and clinical testing of biologic agents, particularly those as inherently complex as mammalian cells, present formidable challenges, such as the need to develop suitable standardized assays and the difficulty of selecting appropriate patient populations for early phase trials. We recommend that scientists, policy makers, and the public discuss these issues responsibly, and further, that a national advisory committee to oversee human trials of cell therapies be established. **NB we did not reccommend a NAC, we think it might be appropriate**. Emergency nurses apply specialist knowledge to the practice of emergency care. This paper discusses the ways in which three emergency nurses understand the nature of their care from their own frames of reference and experiences and presents some of the data collected in a larger study. Various discourses, which compete to inform emergency nurses' understandings of practice, are linked with the notion of nurses as subjects; that is, each discourse may inform, shape and constitute the practice of the nurse and, (...) in turn, the ways in which the patient comes to be known and understood. I will examine the ways in which emergency nurses come to experience or position themselves vis‐à‐vis extant forms of knowledge of emergency care and the extent to which they articulate new or distinctive formulations of emergency care. This paper illuminates the commonalities that constitute the discourses of emergency nursing care, and also analyse nurses' language which demonstrates that within each discourse variations, contradictions and resistances exist. Emergency nursing care occurs in a context of a biomedical discourse that dominates, or tends to dominate, the work of the emergency setting and so to determine acceptable or possible practices. Nevertheless, nurses contest in various ways the ‘truths' that they understand to underpin their practice. Challenges to biomedical discourses are revealed, to some extent, by drawing attention to specific situations and particular struggles encountered in emergency nurses' everyday practice. (shrink)

This article seeks to advance ethical dialogue on choosing standards of prevention in clinical trials testing improved biomedical prevention methods for HIV. The stakes in this area of research are high, given the continued high rates of infection in many countries and the budget limitations that have constrained efforts to expand treatment for all who are currently HIV-infected. New prevention methods are still needed; at the same time, some existing prevention and treatment interventions have been proven effective but are not (...) yet widely available in the countries where they most urgently needed. The ethical tensions in this field of clinical research are well known and have been the subject of extensive debate. There is no single clinical trial design that can optimize all the ethically important goals and commitments involved in research. Several recent articles have described the current ethical difficulties in designing HIV prevention trials, especially in resource limited settings; however, there is no consensus on how to handle clinical trial design decisions, and existing international ethical guidelines offer conflicting advice. This article acknowledges these deep ethical dilemmas and moves beyond a simple descriptive approach to advance an organized method for considering what clinical trial designs will be ethically acceptable for HIV prevention trials, balancing the relevant criteria and providing justification for specific design decisions. In this chapter, Macnish and Asgarinia introduce current thinking and debate around issues of privacy as these relate to the media. Starting with controversies over the definition of privacy, they consider what the content of privacy should be and why it is we consider privacy to be valuable. This latter includes the social implications of privacy and the only recently-recognised concept of group privacy, contrasting it with individual privacy, as well as legal implications arising through laws such as the European (...) Union’s General Data Protection Regulation, concerning the collection of personal data and data subjects’ rights. Finally they turn to specific instances of privacy consideration in the media. These include: -/- The use of telephoto lenses to take pictures of celebrities at a distance without those celebrities’ permission (and the related question as to what is a reasonable expectation of privacy when in a public place); -/- Sharing information on social media (and the related question of whether those who share their data on social networking sites care about their privacy), as well as the availability of data online to research, even though that data has not always been posted for the purposes of research; -/- The challenges posed by anonymity online, including the trade-off between free expression and offensive expression; -/- Hacking and the meaning of fishing expeditions as a practice by the media and exploring what, if anything, is wrong with these; -/- The implications of invading the privacy of politicians, both as a defence of democracy and as a threat to democracy. Although the personal-subpersonal distinction was first proposed in 1969 by D. Dennett, it has been approximately in the last ten years that it has received in­creasing attention and has became a widely used distinction particularly in the philosophy of mind and cognitive psychology literature. While the distinction is ubiquitous there are a few recent proposals about the relationship between the levels, namely, inter alia, the mixed horizontal explanation (Bermúdez 2000), the semantic view of computation (Peacocke 1994), and interaction without reduction (...) (Davies 2000a, b). In this paper I will first describe the way of understanding the distinction shared by the proposals aforementioned. Second, I will show some of the difficulties facing each proposal. Finally, I will suggest what I consider are the misleading assumptions that are at the root of the proposed strategies of inter-level relations. (shrink)

Researchers using either methodology employ an analysis of power to explore experiences in various fields, and raise issues diat are highly relevant to nursing. However, the two methodologies differ and, often, die respective dieories are sharply opposed. In diis paper, die differences bodi from widiin and between each approach are explored, showing dieir tensions and limits. I contend that a reflexive approach to discourse analysis (...) provides insight into some of die methodological challenges diat arise in die context of bodi dieories. It is argued diat die differences between poststructuralism and critical social dieory seem likely to be mellowed by encounters diat treat each other with respect. Esta defensa nos compromete con un nivel personal genuino de explicación y la idea de que los hechos subpersonales no explican hechos personales. Hornsby sostiene, además, que mientras que en Dennett (...) se defiende la autonomía del nivel explicativo personal, en Dennett post-1969 al modificarse la doctrina de base cambia la manera de entender la distinción y con ello se reniega de ambos compromisos, de lo cual se sigue un abandono de la tesis de la autonomía del nivel explicativo personal. La tesis que vamos a sostener en este trabajo es que si bien la distinción de Dennett nos compromete con , no nos compromete con . In this paper we shall argue that, although Dennett's distinction is committed to , it is not committed to . Given that a defense of the autonomy, as Hornsby understands it, presupposes both commitments, it follows that there is no such defense. In crafting our paper on addressing the ethical challenges in HIV prevention research with people who inject drugs,1 we had hoped to stimulate further discussion and deliberation about the topic. We are pleased that three commentaries on our paper have begun this process.2 3 4 The commentaries rightly bring up important issues relating to community engagement and problems in translating research into practice in the fraught environments in which PWID face multiple risks. These risks include acquisition of HIV as well (...) as criminalisation, stigma and lack of access to needed healthcare, prevention and social services. We take this opportunity to respond to the excellent points raised by the commentators. All of the commentaries support our emphasis on robust community engagement with PWID and other stakeholders in designing and conducting HIV prevention research, but urge us to go farther. Wolfe highlights the difficulty of even engaging with community members in oppressive settings, where authorities severely restrict civil liberties of PWID so that even discussing issues related to drug use and enforcement may place individuals at risk. To overcome such limitations, he appropriately suggests interviewing confidentially those who have previously been detained in closed settings as part of the community engagement process. Similarly, Wolfe observes that critical issues can be overlooked with a narrow focus on study procedures if contextual factors before, during or after a study are ignored. For example, he cites the risk of overdose for study participants who have been abstinent during a study and subsequently resume injecting when the study concludes. In this paper Grice's requirements for assertability are imposed on the disjunction of Classical Logic. Defining material implication in terms of negation and disjunction supplemented by assertability conditions, results in the disappearance of the most important paradoxes of material implication. The resulting consequence relation displays a very strong resemblance to Schurz's conclusion-relevant consequence relation.

The best-known argument in favor of the innatism of certain mental structures is still the 'Poverty of the Stimulus Argument'. The general idea of the POSA is that the knowledge which needs to be acquired to develop a certain cognitive capacity vastly exceeds the information available in the environment, so the organism contributes innate information. A review of the literature on linguistic POSA shows that it is not yet fully clear what kind of argument this is and what it really (...) shows. This paper is intended as a diagnosis of the innateness strategy that makes use of the POSA. I will distinguish three types of POSA and argue, first, that the most appropriate type of POSA, according to certain empirical and theoretical criteria, does not seem to be sufficient for linguistic nativism and, second, that for it to be sufficient, it is usually supplemented with an armchair argument which weakens the empirical nature of the innateness hypothesis. La idea general del APE es que el conocimiento que se requiere para desarrollar una cierta capacidad cognitiva excede en gran medida la información disponible en el entorno, de manera que el organismo contribuye con información innata. Un examen de la literatura del APE lingüístico muestra que aún no está del todo claro qué clase de argumento es y lo que realmente muestra. Mi objetivo en este trabajo es ofrecer un diagnóstico de la estrategia innatista que utiliza el APE. Así, distingo tres tipos de APE y argumento, en primer lugar, que la versión más apropiada, según ciertos criterios empíricos y teóricos, no parece ser suficiente para el innatismo lingüístico y, en segundo lugar, que para ser suficiente, suele complementarse con un argumento 'de sillón', cuya consecuencia es que convierte al innatismo en una hipótesis empírica debilitada. In the Philosophy of Cognitive Science, it is a common held view that the modularity hypothesis for cognitive mechanisms and the innateness hypothesis for mental contents are conceptually independent. In this paper I distinguish between substantial and deflationist modularity as well as between substantial and deflationist innatism, and I analyze whether the conceptual independence between substantial modularity and innatism holds. My conclusion will be that if what is taken into account are the essential properties of the substantial modules, i.e. domain (...) specificity and informational encapsulation, then it seems to be such independence. However, if what is taken into account is the function of the substantial modules, then it seems to be a conceptual connection from modularity to substantial innateness. (shrink)

While there is little doubt that Algeria was of enormous importance to the theoretical output that is often recognized as French, here I would like to ask: what is at stake in re-inscribing these French intellectuals as postcolonial? In what ways did the particularities of Algerian history impact French philosophy? Indeed, if the term postcolonial is meant to describe those who were influenced by events in Algeria, then an entire generation of French thinkers might be considered postcolonial to varying degrees. Surely Derrida’s oeuvre was influenced by his experiences in Algeria, but does this make him postcolonial in the same way as Jean-Paul Sartre or Pierre Bourideu, who have also become important figures in postcolonial theory? .
